إن مبدأ دولة القانون معناه خضوع الدولة للقانون وسيادة مبدأ الشرعية فإن المبدأ الأخير لا قيمة له ما لم يقترن بمبدأ تقديس واحترام الأحكام القضائية وكفالة تنفيذها، إذ أن الإخلال بهذا المبدأ يصير مبدأ الشرعية إلى العدم فلا حماية قضائية إلا بكفالة تنفيذ الأحكام الصادرة من السلطة القضائية ولا قيمة للقانون بغير تنفيذ مقتضاه. فالحكم القضائي لا يصدر لمجرد إقرار مسؤولية الإدارة، أو لبيان أحقية المدعى في دعواه وإنما يصدر لتحويل هذا الحق إلى واقع ملموس فما جدوى أن يقر القضاء حقاً أو مركزاً قانونياً دون أن يقترن بحماية تنفيذية تكفل المحكوم له من الاستئثار لمزايا هذا الحق فكفالة تنفيذ الأحكام القضائية ضرورة لا غني عنها لاستقرار الحقوق والمراكز القانونية.

Abstract:

The principle of the rule of law is its meaning of subjecting the state to the law and on the supremacy of legality, then the latter principle has no real value unless it is coupled with the sanctity of judicial rulings and the effectiveness of their enforcement. Any breach of this principle renders legality meaningless, as there can be no judicial protection without the effective execution of judgments issued by the judiciary, and the law itself loses its value if it is not implemented as prescribed.

The true benefit behind initiating lawsuits and issuing judicial rulings ultimately lies in the legal effects that result from the judgment and the practical outcomes that follow. A judicial ruling is not issued merely to acknowledge the liability of the state or to declare the claimant’s right in a dispute; rather, it is issued to transform that right into a tangible reality. There is therefore no usefulness in the judiciary affirming a right or a legal status without accompanying it with effective enforcement that enables the successful party to enjoy the benefits of that right or legal status.

Accordingly, the effective enforcement of judicial judgments is an indispensable necessity for ensuring the stability of rights, legal positions, and social relations
